1. Agreement to Terms

Welcome to Settled. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "Client") and Settled ("we," "us," or "Company") governing your access to and use of our website at letsgetsettled.co and our affidavit of heirship preparation services (collectively, the "Services").

By accessing our website, submitting a consultation request, or engaging our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

2. Description of Services

Settled provides genealogical research, document collection, administrative coordination, and document preparation services for affidavits of heirship in Texas. Our Services include:

  • Comprehensive intake capturing family history and heir information
  • Research to locate supporting documents (death certificates, marriage records, etc.)
  • Assembly of complete files in attorney-ready format
  • Coordination of attorney review and document finalization
  • Execution support (notarization, witnesses)
  • Recording with county clerk and delivery of copies

3. Important Legal Disclaimers

3.1 We Are Not a Law Firm

Settled is not a law firm and does not provide legal advice. We provide administrative, research, and document preparation services only. All legal work, including the determination of legal heirs under Texas intestacy law, is performed by an independent licensed attorney who maintains a direct attorney-client relationship with you.

3.2 Attorney-Client Relationship

When you engage our Services, you will enter into a separate retainer agreement directly with an independent licensed Texas attorney. The attorney—not Settled—provides legal services and bears professional responsibility for the legal sufficiency of your affidavit. Settled facilitates the administrative process but does not practice law or exercise legal judgment.

3.3 Client Responsibility for Information

You are solely responsible for the accuracy and completeness of all information you provide to us, including but not limited to: the identity and number of heirs, family relationships, dates of birth and death, and property information. Settled does not independently verify the accuracy of this information and is not responsible for errors, omissions, or false statements in the information you provide.

3.4 No Guarantee of Outcome

We do not guarantee that your affidavit of heirship will be accepted by any title company, recorded by any county clerk, or achieve any particular legal outcome. Acceptance and recording depend on factors outside our control.

4. Pricing and Payment

4.1 Pricing Structure

Our pricing consists of two components: (1) an attorney flat fee for legal review, and (2) a per-heir research and administrative fee charged by Settled. Current pricing is displayed on our website and will be confirmed in writing before work begins.

4.2 Payment Terms

Payment is due in full before work begins. We accept major credit cards and other payment methods as specified at checkout. You authorize us to charge your payment method for all fees associated with your order.

4.3 Heir Count Determination

Pricing is based on the number of heirs you declare during intake. You are responsible for accurately declaring the heir count. If additional heirs are discovered during the process, additional fees may apply.

4.4 Additional Costs

Government filing fees, document retrieval fees, and other third-party costs are passed through at cost and are in addition to our stated fees.

5. Money-Back Guarantee

If we are unable to complete your affidavit of heirship due to circumstances within our control, you will receive a full refund of fees paid to Settled. The attorney's fee is subject to the attorney's own refund policy. This guarantee does not apply if:

  • You provide inaccurate or incomplete information that prevents completion
  • You fail to respond to requests for information within a reasonable time
  • You decide to cancel or abandon the process
  • Circumstances outside our control prevent completion (e.g., inability to locate required documents, discovery that probate is required)

6. Your Obligations

By using our Services, you agree to:

  • Provide truthful, accurate, and complete information
  • Respond promptly to requests for information or documents
  • Notify us immediately of any changes to information previously provided
  • Comply with all applicable laws and regulations
  • Not use our Services for any unlawful purpose
  • Not misrepresent your identity or your relationship to the decedent or property

7. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Settled or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reproduce any content without our prior written consent.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SETTLED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO SETTLED IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify, defend, and hold harmless Settled and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any inaccurate or incomplete information you provide.

10. Dispute Resolution

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

10.2 Informal Resolution

Before initiating any formal dispute resolution, you agree to contact us at hello@letsgetsettled.co to attempt to resolve any dispute informally.

10.3 Venue

Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.

11. Communications Consent

By providing your phone number and email address and checking the consent box on our forms, you expressly consent to receive calls, text messages (including via autodialer), and emails from Settled regarding our Services, including marketing communications. You understand that:

  • Consent is not a condition of purchase
  • Message and data rates may apply
  • You may revoke consent at any time by contacting us at hello@letsgetsettled.co or by replying STOP to any text message

12. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our website with a new "Last updated" date. Your continued use of our Services after such modifications constitutes your acceptance of the updated Terms.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements you enter into with us, constitute the entire agreement between you and Settled regarding your use of our Services and supersede all prior agreements and understandings.
